Before the Contract is awarded, the successful bidder shall be a licensed contractor pursuant to the Business and Professions Code and shall be licensed in the following appropriate classification(s) of contractor’s license(s), for the work bid upon, and must maintain the license(s) throughout the duration of the Contract: Class A General Engineering or C36 Plumbing Contractor.
This project is expected to receive funding from the U.S. Department of the Interior, Bureau of Reclamation (BOR), in accordance with Section 9504(a) Water Management Improvement of the Omnibus Lands Management Act of 2009, Public Law 111-11. The successful bidder and all subcontractors shall comply with all applicable federal and state laws, rules, and regulations, including but not limited to, the funding requirements of Assistance Agreement, R22AP00516, between BOR and City of Corona for Advanced Metering Infrastructure Program (Grant Agreement), the federal DavisBacon Act, and the prohibition against contractors who are debarred from federal contracting. The funding requirements, and copies of the funding agreement as modified, are included in the Special Conditions found in Section III. Technical Specifications/Scope of Work of this Bid Document.
Federal and state labor law requirements will apply and be enforced. The work is subject to the payment of not less than prevailing wages pursuant to Chapter 1 (beginning at Section 1720 et seq.) of Part 7 of Division 2 of the California Labor Code, as well as Title 8, Section 16000 et seq. of the California Code of Regulations (“Prevailing Wage Laws”). The California Department of Industrial Relations (“DIR”) has issued a special prevailing wage determination, Meter Technician, No. S-2024-05, specific to this project only, which is made a part hereof and provided as Appendix I.
BOR has determined that federal work classifications corresponding most closely to the type of work performed under state work classifications, both general and special, will be accepted, even if the work classification titles do not correspond precisely. For example, the work performed by the special state classification of Meter Technician, as noted above, most closely corresponds to the federal classification of Electrician Intelligent Transportation Technician. The higher of the two applicable classifications (federal and state) must be paid.
The applicable prevailing wage rates may be obtained from the City and from websites for DOL (https://sam.gov/content/wagedeterminations) and DIR (https://www.dir.ca.gov/OPRL/DPreWageDetermination.htm). The applicable general federal wage rates are also included in Appendix VI. Pursuant to SB 854, which amended the Prevailing Wage Laws, this contract is subject to compliance monitoring and enforcement by the DIR. Beginning March 1, 2015, with very limited exceptions, no contractor or subcontractor may be listed on a bid proposal for this contract unless registered with the DIR pursuant to Labor Code section 1725. 5. Beginning April 1, 2015, no contractor or subcontractor may be awarded a contract unless registered with the DIR pursuant to Labor Code section 1725. 5. The DIR registration number for each contractor and subcontractor must be identified on the bid proposal – failure to identify this number could result in the bid being rejected as nonresponsive. It is each bidder’s responsibility to ensure that they have fully complied with SB 854. The City will report all necessary contracts to the DIR as required by the Prevailing Wage Laws.
The Services required under this NIB will be performed as part of an applicable “public works” or “maintenance” project, as defined by the Prevailing Wage Laws, and Contractor shall comply with the provisions of Section 1777.5 of the California Labor Code with respect to the employment of properly registered apprentices upon public works when Contractor employs workmen in an apprenticeable craft or trade.
The successful bidder will be required to furnish the City with a Performance Bond equal to 100% of the successful bid, and a Payment (Labor and Materials) Bond equal to 100% of the successful bid, prior to execution of the Agreement. All bonds are to be secured from a surety that meets all of the State of California bonding requirements, as defined in Civil Code of Procedure Section 995.120 and is admitted by the State of California.
The City has contracted with a thirdparty labor compliance firm, Willdan Engineering, to monitor and enforce the applicable provisions of federal and state Prevailing Wage Laws, including but not limited to, the standard provisions requiring payment of prevailing wages, maintenance and submission of certified weekly payroll records, hiring of apprentices, and compliance and enforcement by the DIR pursuant to SB 854. Contractor shall work with City staff and its consultants to ensure full compliance with applicable Prevailing Wage Laws.
The California Air Resources Board (“CARB”) implemented amendments to the InUse OffRoad DieselFueled Fleets Regulations (“Regulation”) which are effective on January 1, 2024 and apply broadly to all selfpropelled off road diesel vehicles 25 horsepower or greater and other forms of equipment used in California. Failure to provide valid CRCs as required herein may render the proposal nonresponsive.
Award of Contract: The City shall award the Contract to the lowest responsive, responsible bidder as determined on the basis of the summation of the Total Base Bid Schedule and Bid Alternate Items. However, the City may choose to award the contract on the basis of the Base Bid alone or the Base Bid and any selected alternate bid item or combination of selected alternate bid items. The City reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding process.
Issuance of this NIB and/or receipt of bids does not commit City to award a contract.
